Privacy notice
How we process, protect and retain the personal data you entrust to us, under Mexico’s Federal Law on the Protection of Personal Data Held by Private Parties.
1. Identity and address of the data controller
DIAMANE and DIAMANE Diamantes & Tecnología are the trade names under which Cristofferson Reyes Rodríguez operates, with Mexican taxpayer registration (RFC) RERC830216NB0 and address at Felipe de Jesús Tena 31, Fracc. Camelinas, C.P. 58290, Morelia, Michoacán, Mexico.
For the purposes of this notice, the party responsible for processing your personal data is Cristofferson Reyes Rodríguez (hereinafter "DIAMANE"), in compliance with Mexico’s Federal Law on the Protection of Personal Data Held by Private Parties (Ley Federal de Protección de Datos Personales en Posesión de los Particulares, LFPDPPP), its Regulations and the Privacy Notice Guidelines.
2. Personal data we collect
We collect only the data you provide to us. What we collect depends on the request.
Quote request. Contact name, email address and telephone number, together with the technical description of the stone you are looking for (shape, carats, color, clarity, natural or lab-grown, intended use and budget) and whatever message you choose to write us.
B2B account request. In addition to your contact details: business name, Mexican taxpayer registration (RFC), city and state, years operating in the trade, type of business, website or social media, trade references and any supporting documents you attach to establish that you belong to the jewelry trade.
Commercial relationship. Where a purchase takes place, we collect the tax details required to issue the Mexican digital tax receipt (legal name, RFC, tax regime, postal code and CFDI use code), together with the address and contact details of whoever will receive the goods.
We do not collect sensitive personal data. Nor do we collect asset or financial data beyond what is strictly necessary to invoice, collect payment and, where applicable, meet the identification obligations described in section 5.
3. Third-party data you provide to us
The B2B account request asks you for trade references, which usually include the names and contact details of other people or businesses. By providing them, you state that you have the authorization required to do so. That data is used solely to validate your request, is never added to any mailing list, and is kept as part of the application file.
4. Purposes of processing
Primary purposes (necessary for our relationship with you): responding to your quote request; preparing and following up on the quote; validating your B2B account request and granting you access to the wholesale catalog; processing, preparing and shipping your order; invoicing and collecting payment; handling warranties and queries; and complying with the legal and tax obligations that apply to us.
Secondary purposes (not necessary; you may object at any time): letting you know about stone availability, new services and trade content, and running satisfaction surveys.
If you do not want your data processed for the secondary purposes, you may say so by writing to [email protected]. Your refusal will never be grounds for denying you the services you request, nor for withdrawing your access to the catalog.
5. Anti-money-laundering obligations
Trading in precious stones, precious metals and jewelry is a Vulnerable Activity under Mexico’s Federal Law for the Prevention and Identification of Transactions with Funds from Illicit Sources (LFPIORPI). For that reason, when a transaction reaches the thresholds set out in that law, we are required to identify the client and to compile a file that may include official identification, RFC or CURP, proof of address and, where applicable, information on the beneficial owner.
That information is collected to comply with a legal obligation, is held under restricted access and, where the law so requires, is reported to Mexico’s Financial Intelligence Unit (UIF) and to the tax administration (SAT). This transfer does not require your consent, under Article 37 of the LFPDPPP. The LFPIORPI itself requires us to retain these files for five years.
6. Data transfers
We do not sell, assign or trade your personal data. We share it only to the extent necessary to operate the service you requested, with: infrastructure and email providers; our electronic invoicing provider; and the couriers and insurers that move the goods, who are given the name, address and telephone number of the recipient, along with the declared value for insurance purposes. These transfers do not require your consent under Article 37 of the LFPDPPP. We may also disclose your data when required to do so by a competent authority.
7. The ICERT and STIJ platforms
This notice covers the diamane.mx site and your commercial relationship with DIAMANE. The ICERT digital certification service and the STIJ platform run on their own systems and, when the final owner of a piece activates their registration, the processing of their data is governed by the privacy notice presented to them at that point. DIAMANE does not register the final owners of the pieces you sell on its own initiative.
8. ARCO rights and withdrawal of consent
You have the right to know what personal data we hold about you, what we use it for and the terms of that use (Access); to request that your information be corrected when it is out of date, inaccurate or incomplete (Rectification); to ask us to delete it from our records when you consider it is not being used in line with the principles of the law (Cancellation); and to object to the use of your data for specific purposes (Objection). These are known collectively in Mexico as ARCO rights. You may also withdraw at any time any consent you have given us.
To exercise any of these rights, send your request to [email protected], stating your name, a means of sending you our reply, a clear description of what you are requesting and documents proving your identity. We will respond within a maximum of twenty business days.
Cancellation and objection do not apply to information we are required to retain by law, in particular the information covered by section 5 and our tax documentation.
9. Security measures
We maintain reasonable administrative, technical and physical measures to protect your data against damage, loss, alteration, destruction or unauthorized use, including per-user access control, encryption in transit and periodic backups. The documents you attach to a B2B account request are stored with access restricted to the staff who validate applications.
10. Use of cookies
This site uses first-party and third-party cookies to remember your session, measure page usage and improve the service. You can disable them in your browser settings; if you do, some features of the B2B catalog may stop working correctly.
11. Changes to this notice
This notice may be amended to reflect changes in legislation, in our internal practices or in the services we offer. Any amendment will be published at this same address, diamane.mx/privacidad.
